PRIVACY NOTICE

What is the purpose of the Privacy Notice?

The Privacy Notice describes how TSTT collects, receives, uses, stores, shares, transfers, and processes Users’ personal information. Users include but are not limited to any person who has created an account on the Site and/or visited the Site and includes but is not limited to Shoppers and Sellers.

By accessing or using the Parlour e-commerce Site or the Platform, the User acknowledges that they have read and understood this Privacy Notice.

For the purpose of this Privacy Notice, any reference to “we”, “us” or “our” relates to TSTT and references to “you” or “your” relates to Users.

Capitalized Terms not otherwise defined herein shall have the same meaning as set forth in the Terms and Conditions of Use.

 

How is information Collected?

Information is collected from Sellers and Shoppers who operate on or transact on the Platform. This Notice applies to any personal information provided by Sellers and Shoppers when visiting the Platform website or interacting with the Seller Portal. Here are the types of personal information collected.

Information You Give Us: We receive and store any information you provide in relation to the Platform’s Services.  You can choose not to provide certain information. However, you may not be able to take advantage of many of our Services.

Information is collected while you access, browse, view, or otherwise use the Site or Platform to do any of the following:

  • Search or shop for products on the Site.
  • Add or remove an item from your cart.
  • Download, stream, view, or use content on a device or through a service or application on a device.
  • Provide information in your Account (you may have more than one Account if you have used more than one email address or mobile number when shopping with us) or your Profile.
  • Upload your contacts.
  • Offer products for sale on the Site.
  • Communicate with the Company by phone, email, or otherwise.
  • Complete a questionnaire, a support ticket, or a contest entry form.
  • Upload or stream images, videos, or other files.
  • Participate in discussion boards or other Platform features.
  • Specify a special occasion reminder.
  • Enable product availability alerts such as available to order notifications.
  • Provide and rate Seller or Product reviews.

 

Personal Information that will be collected may include but is not limited to:

  • Identifying information such as your full name, residential address, registered address, mailing address, telephone numbers, mobile telephone number and current and valid email address.
  • Payment information (e.g. bank account details, credit card number).
  • Your date of birth and age.
  • Your location information.
  • Your IP address.
  • Names of persons, addresses, and phone numbers listed in your addresses.
  • Email addresses of your friends and other people.
  • Content of reviews and emails to us.
  • Personal description and photographs of you.
  • Images and videos
  • Information and documents regarding identity, including national identification and driver’s license numbers.
  • Corporate and financial information.
  • Credit history information.
  • Device log files and configurations, including Wi-Fi credentials.
  • Content interaction information, such as content downloads, streams, and playback details, including duration and number of simultaneous streams and downloads, and network details for streaming and download quality, including information about your internet service provider.
  • Device metrics such as when a device is in use, application usage, connectivity data, and any errors or event failures.
  • Services metrics (e.g., the occurrences of technical errors, your interactions with service features and content, your settings preferences and backup information, location of your device running an application, information about uploaded images and files such as the file name, dates, times, and location of your images).
  • Version and time zone settings.
  • Purchase and content use history, which we sometimes aggregate with similar information from other Users to create features like Top Sellers.
  • The full Uniform Resource Locator (URL) clickstream to, through, and from our websites, including date and time; products and content you viewed or searched for; page response times, download errors, length of visits to certain pages, and page interaction information (such as scrolling, clicks, and mouse-overs).
  • Phone numbers used to call the Customer Experience (CX) Team.
  • Images or videos when you shop in our online stores.

Automatic Information: We automatically collect and store certain types of information about your use of the Platform’s Services, including information about your interaction with content and services available through the Platform’s Services. Like many websites, we use "cookies" and other unique identifiers, and we obtain certain types of information when your web browser or device accesses the Platform and other content served by or on behalf of TSTT on other websites.

Information from Other Sources: We might receive information about you from other sources, such as updated delivery and address information from local carriers, which we use to correct our records and deliver your next purchase more easily.

Examples of information we receive from other sources include:

  • Updated delivery and address information from our carriers or other third parties, which we use to correct our records and deliver your next purchase or communication more easily.
  • Account information, purchase or redemption information, and page-view information from some merchants with which we operate co-branded businesses or for which we provide technical, fulfillment, advertising, or other services.
  • Information about your interactions with products and services offered by our subsidiaries.
  • Search results and links, including paid listings (such as Sponsored Links) and
  • Credit history information from credit bureaus, which we use to help prevent and detect fraud and to offer certain credit or financial services to some Users.

 

For What Purposes Does the Platform Use Your Personal Information?

The Platform uses your personal information to operate, provide, develop, and improve the products and services that we offer to Users. These purposes include:

  • Verify your identity.
  • Purchase and delivery of products and services. We use your personal information to take and handle orders, deliver products and services, process payments, and communicate with you about orders, products and services, and promotional offers.
  • Provide, troubleshoot, and improve Services. We use your personal information to provide functionality, analyze performance, fix errors, and improve the usability and effectiveness of the Platform’s Services.
  • Allow you to use your account on multiple devices and transfer your account to another device.
  • Recommendations and personalization. We use your personal information to recommend features, products, and services that might be of interest to you, identify your preferences, and personalize your experience with the Platform’s Services.
  • Comply with legal obligations. In certain cases, we collect and use your personal information to comply with laws. For instance, we collect from Sellers, information regarding place of establishment and bank account information for identity verification and other purposes.
  • Communicate with you. We use your personal information to communicate with you in relation to the Platform’s Services via different channels (e.g., by phone, email, chat).
  • Advertising. We use your personal information to display interest-based ads for features, products, and services that might be of interest to you. We do not use information that personally identifies you to display interest-based ads.
  • Fraud Prevention and Credit Risks. We use personal information to prevent and detect fraud and abuse in order to protect the security of Users, the Platform and others. We may also use scoring methods to assess and manage credit risks.

 

Who Is Your Information Shared With?

We share your personal information with third parties as detailed below:

  1. a) With other Users and Site visitors. Once you register the following information is made public and visible to all Users of the website:

- Your Username, country,

- Photos you upload

- Your published portfolio,

- Content Creation information,

- Ratings, and additional information you may choose to add to your public profile. Your information will also be shared with other Users when you message or otherwise communicate with such Users. When you publish your information and/or share your data with other website Users, you do so at your own risk. If you choose to share personal information with other Users, including Sellers providing you a service via the website the Company cannot ensure that all Users will keep your information private and confidential, and it is your responsibility to ensure that other Users will comply with your standards.

  1. b) With Service Providers. We share personal information for business purposes with service providers that provide us with services for the purpose of operating the Site and, billing and payment processors and vendors processing payments. These include, among others, hosting services, data and cybersecurity services, web analytics and performance tools, translation tools, mailing systems, data optimization and marketing services, data enrichment services, legal and financial advisors, or technical consultants. Consistent with applicable legal requirements, we take appropriate technical and organizational measures to require third parties to adequately safeguard your personal information and only process it in accordance with our instructions.
  2. c) For legal reasons. We share personal information with law enforcement agencies, public authorities or other parties in order to respond to a court order, judicial process or to regulatory authorities, if we believe we are required to do so by law, or that doing so is reasonably necessary to comply with legal processes; when we believe it necessary or appropriate to disclose personal information to law enforcement authorities, such as to investigate actual or suspected fraud or violations of law, breaches of security, or breaches of this Notice; to respond to claims against us; and to protect the rights, property, or personal safety of the Company, Users, or the public.
  3. d) For payments and fraud detection. We share personal information with payment processors, fraud detection agencies and similar third parties for the purpose of facilitating payments done via the website and securing the website and protecting it against fraud, unauthorized transactions (such as money laundering), claims or other liabilities.
  4. e) With Users with whom you interact. We share personal information to help facilitate interactions between Users. For example, if you are a Shopper, we may share certain limited information about you with the Seller to ensure the services you receive from the Seller will fit your needs; such sharing of information is limited in scope and is only intended to improve the services provided by the Seller and your User experience.
  5. f) In the context of a corporate transaction. Personal information will also be disclosed if we go through a business transition such as a merger, sale, transfer of all or a portion of the Company’s assets, acquisition, bankruptcy, or similar event. In the event that we sell any business or assets, we will disclose your data to the prospective buyer. If we or substantially all of our assets are acquired by a third party, information held by us about our Users will be one of the transferred assets.

 

What Information Can I Access?

You can access your information, including your name, address, payment options, profile information, and purchase history in the "Your Account" section of the Site.

Examples of information you can access include:

  • Status of recent orders (including subscriptions).
  • Your complete order history.
  • Personally identifiable information (including name, email, password, and address book).
  • Payment settings (including payment card information, promotional certificate and gift card balances, and 1-Click settings).
  • Email notification settings (including Product Availability Alerts, Delivers, Special Occasion Reminders and newsletters).
  • Recommendations and the products you recently viewed that are the basis for recommendations (including Recommended for You and Improve Your Recommendations).
  • Shopping lists and gift registries (including Wish Lists and Baby and Wedding Registries).
  • Your content, devices, services, and related settings, and communications and personalized advertising preferences.
  • Content that you recently viewed.
  • Your Profile (including your product Reviews, Recommendations, Reminders, and personal profile).

 

How Secure Is Information About Me?

We design our systems with your security and privacy in mind including the following:

  • We work to protect the security of your personal information during transmission by using encryption protocols and software.
  • We follow the Payment Card Industry Data Security Standard (PCI DSS) when handling credit card data.
  • We maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of personal information. As part of our security procedures, we may ask you to verify your identity before we disclose personal information to you.

We recommend using a unique password for your Account that is not used for other online accounts. Be sure to sign off when finished using a shared computer. It is important for you to protect against unauthorized access to your password and to your computers, devices, and applications.

 

What About Advertising?

  • Third-Party Advertisers and Links to Other Websites: The Site may include third-party advertising and links to other websites and apps. Third-party advertising partners may collect information about you when you interact with their content, advertising, and services.

 

  • Use of Third-Party Advertising Services: We provide ad companies with information that allows them to serve you with more useful and relevant Parlour ads and to measure their effectiveness. We never share your name or other information that directly identifies you when we do this. Instead, we use an advertising identifier like a cookie or other device identifier. For example, if you have already downloaded one of our apps, we will share your advertising identifier and data about that event so that you will not be served an ad to download the app again. Some ad companies also use this information to serve you relevant ads from other advertisers.

 

How long is Data stored?

Your information is stored as long as your account remains active and only for as long as is required to fulfil the purpose for which it was collected.

 

How is Data destroyed?

Users may delete their account at any time, through the settings menu. A User deleted account will result in the permanent deletion of all personal information and would not be able to be recovered.

Information where other members are involved (conversations with other people, transactions you've made, reviews you've given to others, etc.) will not be removed when you delete your account, however, your name will no longer be displayed next to this information.

 

What Choices Do I Have?

Many of the Platform’s Services also include settings that provide you with options as to how your information is being used.

  • You can add or update certain information on your profile. When you update information, we usually keep a copy of the prior version for our records.
  • If you do not want to receive emails or other communications from us, please adjust your account settings (specifically the Customer Communication Preferences). If you do not want to receive in-app notifications from us, please adjust your notification settings in the app or device. If you do not want to see interest-based ads, please adjust your Advertising Preferences in the account settings.
  • The Help feature on most browsers and devices will tell you how to prevent your browser or device from accepting new cookies or other identifiers, how to have the browser notify you when you receive a new cookie, or how to block cookies altogether. Because cookies and identifiers allow you to take advantage of some essential features of the Site, we recommend that you leave them turned on. For instance, if you block or otherwise reject our cookies, you will not be able to add items to your shopping cart, proceed to checkout, or use any services that require you to Sign in.
  • If you want to browse the Site without linking the browsing history to your Account, you may do so by logging out of your Account and blocking cookies on your browser.
  • You will also be able to opt out of certain other types of data usage by updating your settings on the Site.

In addition, to the extent required by applicable law, you may have the right to request access to or delete your personal information. If you wish to do any of these things, please contact the CX Team. Depending on your data choices, certain services may be limited or unavailable.

 

What happens when there are changes to the Notice?

This Privacy Notice may change from time to time; any changes we make to this Privacy Notice will be posted on the Site. Should the Company make any material changes to this Privacy Notice, you will be notified via the Site, or by other reasonable means. Continuing to use the Services after a notice of changes has been communicated or published constitutes your acceptance and agreement of the changes to this Privacy Notice. We will seek your consent when applicable law so requires.

 

What if that doesn’t work for me?

TSTT encourages you to review changes carefully. If you agree to the changes, then please continue to use the Site.

If, however, you do not agree to any of the changes you may discontinue use of the Site or close your Account.

 

Conditions of Use, Notices, and Revisions

If you choose to use the Site or access any of the Services, your use and any dispute over privacy is subject to this Privacy Notice and our Terms and Conditions of Use, including limitations on damages, resolution of disputes, and application of the laws of the Republic of Trinidad and Tobago.
